The ground rules for using this site and engaging with MovingDrew.
By visiting this website, sending a message through the contact form, signing up for an account, or otherwise engaging with the cash home buying service offered through MovingDrew, you are agreeing to be bound by these terms.
If anything in this document does not sit right with you, the right move is to stop using the site and reach out separately by phone or in writing to discuss whatever the concern is. Continued use of the site signals continued agreement.
MovingDrew is a personal cash home buying service operated by Andrew Pearson. It is not a real estate brokerage, a listing service, a mortgage lender, or a title company. The service offered is the direct purchase of residential property for cash, on terms agreed in writing between the homeowner and Andrew.
Communication about a possible cash offer is informational only until a written purchase agreement has been signed by both parties. No commitment to buy a specific property exists until such an agreement is in place.
To use this site and submit a property for review, you must:
Submissions that misrepresent ownership, hide material defects, or otherwise involve fraud may be declined and may be reported to appropriate authorities where required by law.
If you create an account on this site, you are responsible for keeping the login information confidential and for any activity that takes place under your account. Notify MovingDrew promptly if you suspect unauthorized access.
Reasonable safeguards are in place on the storage side, but no system is fully immune to risk. Treat your password the way you would a key to the front door.
Reaching out, submitting property details, or creating an account does not obligate MovingDrew to extend a cash offer for any specific property. Each property is evaluated on its individual merits and current circumstances, and an offer may be declined or modified for any lawful reason.
Conversely, a written cash offer extended through this service does not obligate the homeowner to accept. Both sides are free to walk away at any point prior to signing a purchase agreement.
When a cash offer is extended, it will be communicated in writing and will include the offered price, the proposed closing window, and any conditions tied to the offer. The offer remains valid for the period stated in the written document and may be withdrawn or revised after that window unless otherwise agreed.
Closing costs handled on the buyer side are covered by MovingDrew unless explicitly stated otherwise. Title work, escrow, and recording are coordinated through a licensed title company or closing attorney.
You agree to provide information that is accurate, complete, and current as of the date of submission. Knowingly providing false details, omitting material facts about the property, or impersonating another individual is a breach of these terms.
Information you submit is handled according to the Privacy Policy. By submitting information, you grant MovingDrew the right to use it for the purposes of reviewing the property, extending an offer, and completing a sale if accepted.
When using the site, you agree not to:
Access to the site may be suspended or terminated at any time for conduct deemed to violate these terms or to threaten the safety of the service.
The MovingDrew name, logo, photography, copy, and overall site design are owned by Andrew Pearson and protected by applicable intellectual property laws. None of that material may be copied, redistributed, or reused for commercial purposes without prior written permission.
Property photographs submitted by homeowners remain the property of the homeowner. Submitting them grants MovingDrew a limited license to use them strictly for the purpose of reviewing the property and progressing the sale, if any.
The site and the service are provided on an as-is and as-available basis. While reasonable efforts are made to keep the information accurate and the site running smoothly, no warranty is made that the service will be uninterrupted, error-free, or that any specific outcome will result from reaching out.
Information presented on the site is for general informational purposes and does not constitute legal, financial, or tax advice. Consulting a licensed professional for guidance specific to your situation is always a sound move.
To the maximum extent permitted by applicable law, MovingDrew and Andrew Pearson personally will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the service. Total liability for any direct damages tied to use of the site is limited to the greater of the amount paid by you to MovingDrew, if any, or one hundred United States dollars.
Plain language version: Things sometimes go sideways online. If a bug, outage, or miscommunication happens on the website itself, you will not have grounds to sue for huge amounts based on that alone. A signed purchase agreement, on the other hand, carries its own contractual remedies separate from this clause.
Any dispute arising out of or relating to your use of this site or to the cash buying service, that cannot be resolved through good faith discussion, will be settled by binding individual arbitration administered by a reputable arbitration organization in the State of Missouri.
Both sides waive the right to a jury trial and the right to participate in any class action with respect to disputes governed by this section. Nothing in this clause prevents either party from seeking equitable relief in a small claims court or from reporting unlawful conduct to government authorities.
These terms may be updated from time to time as the service evolves, as laws change, or as practical experience suggests a clearer way to write something down. The effective date at the top of the page will reflect the most recent update.
Continued use of the site after a change indicates acceptance of the revised terms. If a change is material, reasonable effort will be made to highlight it on the site itself for a period.
These terms are governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any matter not subject to the arbitration clause above will be heard in the state or federal courts located within Missouri, and both parties consent to that jurisdiction.
Questions about these terms, or about anything in the service that they describe, can be sent directly through any of the channels below.
